For about a year and half, Information technology and IT-enabled service (ITES)companies in Karnataka were uncertain whether they should comply with the Industrial Employment (Standing Orders) Act, 1946. While some chose to comply and established certified standing orders, others were in a 'wait and watch' mode in the hope that the Karnataka government will re-instate the exemption from the applicability of the SO Act that was available to the IT/ITES industry for over a decade.  After a significant wait the Karnataka government has, through its recent notification dated 25 January 2014 (Notification), announced the renewal of this exemption for another 5 years, albeit with a lot more conditions than any prior exemption. This Trilegal alert analyses this development.
