Maintenance amount has always been a mystery every month as we tend to, blindly, pay the amount with analyzing its components. As the house owner or the occupier you are supposed to know about various components that fall under the maintenance bill.

According to the legal experts, housing societies cannot have any rules set for prohibiting the residents from keeping pets or charge them extra. In accordance with an order passed by a consumer court in Mumbai, during 2010, charging residents for having pets were termed illegal. The court also directed the housing society to return the money to the residents accordingly. Therefore, it is significant to know your rights as a resident and also to be aware of the components that are considered under maintenance bill so that you are not taken for a ride.

Maintenance Components:
The maintenance bill can be split under various categories while some charges are shared equally by all the society members whereas others are decided on the basis of the flat or the area owned by the concerned member. The following are the main broader components:

Property Tax:
The civic administration decides the amount on factors such as the age of property, usage and the type of construction. For example, the newly built apartment can demand a higher property tax when compared to the property that is 10 or 15 years old. The carpet area of the flat that is occupied by the resident is also considered when the civic body collects the tax. Experts mention that the location of the property is also the key component of property tax.

Service charges:
This is the amount charged by the housing society for the providing the members all the available amenities. The charge includes salaries of security guards, sweepers, gardeners & housekeeping staffs, auditor's fees for maintaining the society's accounts, premium paid for insuring the building, administration expenses and also for common utilities such as power consumption for lifts & common area, intercom facilities and CCTV camera maintenance. Service charge is, basically, divided equally among all the members; however, there are instances where the housing members were asked to pay the service charge on the basis of the carpet areas of the flats.

Water charges:
Some societies collect the water charges on the basis of respective usage by installing water meters in each flat whereas most distribute the final bill amount equally among all the members.

Parking charges:
The society has the power to define the number of vehicles that can be parked and charges accordingly. Some use the lottery system to provide parking space which goes on a rotation basis. However, the extra money cannot exceed the monthly maintenance money collected from the member.

Maintenance and Repair charges:
This factor is majorly for the maintenance of common areas and buildings, repairing the exteriors, painting & decorating the common area and refurbishing the structure also includes. The charge is based upon the size of each flat.

The maintenance charges differ based upon the age of building and also factors such as the number of elevators or lifts. The secret mantra is- The higher the number of occupants in the society, the lower the charges. In case, the housing society levies additional charges unless it is specified in the by-laws drafted while setting it up, the member has the right to take this issue to the registrar of housing societies which will later be verified under Housing Societies Act.

On the other hand, the society can lodge a complaint against the member for the recovery of outstanding charges. If the member creates any non-payment issues, the housing society has the right to impose 21% interest on the outstanding amount.
